Checked against 8 NYCRR 100.10 and NYSED's Home Instruction Q&A on 2026-10-07. Your district may have its own forms and process.
New York's home instruction rule is 8 NYCRR 100.10. Here is the order the paperwork goes in, with the deadlines from the regulation.
| # | Step | Deadline in 100.10 |
|---|---|---|
| 1 | Letter of intent to your district superintendent | Each year "by July 1st of each school year". Starting after the school year begins? "within 14 days following the commencement of home instruction within the school district" (see mid-year). |
| 2 | District sends you 100.10 and an IHIP form | "Within 10 business days of the receipt of the notice of intention to instruct at home" |
| 3 | IHIP (your plan for the year) | "Within four weeks of the receipt of such materials, or by August 15th", whichever is later |
| 4 | District reviews the IHIP | "Within 10 business days of receipt of the IHIP, or by August 31st", whichever is later |
| 5 | Quarterly reports | Four during the year, on the dates in your IHIP (see quarterly reports) |
| 6 | Annual assessment | With the fourth quarterly report (see annual assessment) |
The IHIP lists the subjects required for your child's grade (see what an IHIP must include). Instruction hours: "The cumulative hours of instruction for grades 1 through 6 shall be 900 hours per year. The cumulative hours of instruction for grades 7 through 12 shall be 990 hours per year." NYSED also says "Parents are required to keep attendance records for each student".
The kit has fill-in forms for each step (letter of intent, IHIPs by grade band, quarterly report, hours log and annual assessment sheet) and a year-at-a-glance deadline calendar.
